Owners Association, Inc. RULES & REGULATIONS

DOGS /PETS

For safety reasons, no dogs/pets shall be permitted in any of the public areas of the Association unless HELD ON A LEASH. Pet Owners are responsible for any injury or damage caused by their pet. It is the responsibility of the pet owner to clean up after their pet. IN NO CASE SHALL DOGS/PETS BE ALLOWED IN THE POOL OR TENNIS AREA.

POOL

Pool hours are 8:00AM to 9:00PM when the pool is opened for the season. No diving, sliding or running is permitted in the pool area. NO GLASS containers, NO DOGS/PETS are allowed in the pool area. Pool usage is limited to residential owners and their guests only.

SWIMMING IS AT YOUR OWN RISK. BEAR CREEK DOES NOT PROVIDE LIFEGUARD SERVICES. RESCUE DEVICES IN CASE OF EMERGENCY ARE LOCATED ON THE POOL FENCE.

TENNIS COURTS

The use of the tennis courts is limited to the owners and their guests only. Proper tennis attire and footwear must be worn at all times. To increase income and community participation, the Association may, from time to time, allow outside use of the tennis courts.

NOISE

Unit Owners, Guests and Renters are requested to curtail outside and inside noise before 8:00AM and after 10:00PM. Should you experience excessive or unusual noise or behavior at any time, please call Stratton Property Management 297 – HOME (4663) between 8:00AM and 4:00PM or the Resort all other hours at 802- 297- 2500. Either the manager will be paged or security will be dispatched.

TRASH

Trash must be carried to and placed inside the utility sheds outside of each residence. Please make sure trash bags are securely tied. From an environmental standpoint, please use clear plastic bags for recyclables and black or white bags for trash.. All clean recyclables, mixed paper, cardboard, glass and metal containers and

#1-#7 can go in the same bag.

ALL TERRAIN VEHICLES

Snowmobiles, mini-bikes, all terrain or other hazardous or noisy vehicles are not permitted on the Association property at any time.

VEHICLES

Under no circumstances may any vehicle other than a car, van, or small truck with valid registration and insurance, park on Bear Creek property.

THROWING AND DISCARDING OF OBJECTS

Throwing or discarding of any objects on to common property is prohibited. This includes cigarettes, cigars, matches, coals/ashes, or trash of any nature. Please assist in keeping the grounds and parking lot free of trash of any type.

COAL/ASH DISPOSAL

Fire is an ever present danger. Make sure that fireplace doors are closed tightly before retiring or before leaving your unit for any period of time. UNDER NO CIRCUMSTANCES SHOULD HOT COALS/ASHES BE PLACED IN THE GARBAGE, ON ANY DECK OR THROWN IN THE SNOW OR ON GROUND.

The caretaker will remove your fireplace ashes. Otherwise please place your coals/ashes in the metal ash can for that pupose at the dumpster storage area for safe disposal.

VIOLATIONS

Violations of the Rules and Regulations, other than Assessments, shall be subject to the following fine schedule:

First violation for a specific rule infraction is a warning letter. Second violation for the same rule infraction is $50.00.

Third violation for the same rule infraction is $100.00.

ASSESSMENTS

Unit Owners are responsible for promptly paying assessments of any kind, including, regular, special, reimbursement for services by the Association, or other. The annual budget assessments are due in quarterly payments on November 1, February 1, May 1, and August 1, regardless of whether or when a statement is received. Owners should presume that the amount and payment location are the same as the previous statement unless changed by written notice from the Association. Checks or other forms of payment are to be payable to Bear Creek in the full invoiced amount and paid in accordance with invoice instructions. If you dispute the amount invoiced you must communicate your dispute in writing to John Lancaster at Stratton Property Management, 5 Village Lodge Road, Stratton Mountain, VT 05155 or by email to [email protected] (unless a new address is provided by written notice from the Association). Any statement sent to the bank regarding an amount due, including any statement on a check, will be ineffective.

Any assessment payment not received by the first day of the month following the month in which the payment was due is delinquent. Any unit owner with an outstanding balance of the full amount of the most recent assessment on the first day of the month following the month in which the payment was due will incur $100 late fee. Payments will be applied to the oldest outstanding assessment first.

Interest will accrue at 1.5% per month (simple interest at 18% per year) on any delinquent balance of $500 or more. Interest will not accrue for the month in which payment was due for that quarter. Interest will begin to accrue on the first of the month following the month in which payment was due.

Amended March 2, 2013

The Board may initiate collection action against any unit owner delinquent in assessment payments in an amount substantially equal to two quarterly dues. Such action may include but not be limited to referral to counsel, reporting to credit reporting agencies, filing for foreclosure, and any other actions as are available and appropriate. The Board may consider the recent payment record of the unit owner in choosing collection action. The cost of any collection action is the obligation of the delinquent unit owner in accordance with the Association Declaration..
